Description

Document the transfer or licensing of rights inhering in the work of innovators that result from research projects, including sponsored awards and corporate research contracts, from the university to other entities. These records found in all media (paper, digital, or other) may include but are not limited to:

  • original patents; patent applications;
  • copyright and trademark registration; licensing agreements;
  • data privacy agreements, including but not limited to Certificates of Confidentiality (CoC) agreements giving permission for institutional researchers to use other patented inventions in their research;
  • innovation disclosures that identify the inventor, developer, researcher, or author, the type of innovation created and any obligations, such as sponsored research funds, including but not limited to inventions,
  • copyright, software and digital media, research tools and trademark; and,
  • related documentation.
Retention and Disposal Instructions

(a) Retain original patents, formal invention assignment forms, license agreements, patent legal transactions, copyrights and trademarks registrations, invention disclosure forms, in perpetuity, unless otherwise dictated by the terms of the agreement;

(b) Retain data privacy agreements in perpetuity, unless otherwise dictated by any applicable human subjects' protocols;

(c) 12 years from expiration of license or agreement for all other records, destroy.

Exception: In the event of a subpoena, audit, legal hold, public records or similar state or federal information request, halt until further instructed any scheduled disposal activities, including purging or transferring material to University Archives.
